Fiktīvu un simulatīvu darījumu apstrīdēšanas problemātika

Abstract

Jau kopš Senās Romas laikiem ir pastāvējuši fiktīvi un simulatīvi darījumi, tomēr Latvijas tiesību sistēmā un doktrīnā šo darījumu aspekti līdz šim nav plaši pētīti, neskatoties uz šo darījumu pastāvīgo klātbūtni civiltiesiskajā apritē. Fiktīvo un simulatīvo darījumu dažādās izpausmes civiltiesiskos darījumos ir radījušas grūtības to atpazīšanā un juridiskajā kvalifikācijā, turklāt vispārīgais procesuālais regulējums nav izrādījies pietiekami efektīvs šo darījumu apstrīdēšanai. Darba mērķis bija noskaidrot minēto darījumu jēdzienus, juridisko kvalifikāciju Latvijas un ārvalstu tiesībās, identificēt fiktīvo un simulatīvo darījumu apstrīdēšanas problemātiskos jautājumus, lai sniegtu ierosinājumus civilprocesuālo normu pilnveidei. Darba uzdevumos ietilpa apkopot juridiskajā literatūrā, normatīvajos aktos un tiesu praksē izteiktos viedokļus par fiktīviem un simulatīviem darījumiem, noskaidrot šo darījumu jēdzienus, sastāvdaļas un pazīmes dažādos darījumu (līgumu) veidos, noskaidrot fiktīvu un simulatīvu darījumu apstrīdēšanas īpatnības un pastāvošo tiesu praksi. Pētījuma rezultātā autors sniedz priekšlikumus civilprocesuālā regulējuma pilnveidošanai fiktīvu un simulatīvu darījumu apstrīdēšanai, lai veicinātu tiesiskumu un civiltiesiskās apgrozības stabilitāti.

Fictitious and simulated transactions have existed since the time of Ancient Rome, however, despite the constant presence of these transactions in the civil legal circulation, the aspects of these transactions are not yet widely studied in the Latvian law doctrine and legal system. The various manifestations of fictitious and simulative transactions in civilian law transactions have caused difficulties in their recognition and legal qualification, furthermore, the general procedural regulation has not proven to be effective enough to dispute these transactions. The purpose of this thesis is to provide suggestions for the improvement of civil procedural norms, which is achieved by clarifying the concepts and legal qualifications of fictitious and simulative transactions in Latvian and foreign law systems, in addition to identifying the problematic aspects of questioning these transactions. The main tasks of this work is to clarify the concepts, components and features of various transactions and contracts, as well as to clarify the peculiarities of contesting fictitious and simulative transactions and existing court practice. This will be achieved by summarizing the expressed opinions in legal literature, regulatory acts and case law. As a result of the research, the author provides proposals for the development of civil procedural regulations in order to dispute fictitious and simulative transactions, thus protecting the rule of law and the stability of civil law circulation.
