Valsts mantas pārvaldīšanas juridiskās problēmas

Abstract

Maģistra darbā sniegts ieskats valsts nekustamo īpašumu un kustamās mantas pārvaldīšanas problemātikā. Darba mērķis ir padziļināti izpētīt un analizēt valsts mantas pārvaldīšanas pilnu ciklu – ar mantas iegūšanu saistītos aspektus, aktuāliem jautājumiem tās pārvaldīšanas laikā un noslēdzošā posma – mantas atsavināšana – īstenošanu. Īpaša uzmanība pievērsta valstij piederošajām kapitālsabiedrībām un tiešās pārvaldes iestādēm, kuru pamatdarbības veids ir nekustamo īpašumu pārvaldīšana, rodot atbildi – pamatot katra pārvaldītāja īpašo kompetenci ir sarežģīti. Lai radītu izpratni par tiesiskā regulējuma īstenošanu praksē, apskatīta veselības resora pieredze. Darba noslēgumā autors izvirza vairākus priekšlikumus veikt grozījumus tiesiskajā regulējumā, lai novērstu darba ietvaros analizētās juridiskās problēmas.

The Master’s thesis provides an insight into the problems of managing state owned real estate and movable property. The aim of the thesis is to study and analyse in depth the full cycle of state property management – aspects related to the acquisition of property, topical issues during its management and the implementation of the final stage – the disposal of property. Particular attention is paid to state-owned corporations and direct administrations whose core business is the management of immovable property, and the answer is that it is difficult to justify the specific competences of each manager. The experience of the health sector is examined to provide an understanding of the implementation of the legal framework in practice. The thesis concludes with a number of proposals for amendments to the legal framework to address the legal problems analysed in the paper.
