dc.description.abstract | Tiesības uz taisnīgu tiesu sastāv no vairākiem elementiem, viens no tiem ir tiesas spriešanas atklātuma princips. Covid-19 pandēmijas laikā tika noteikti dažāda veida ierobežojumi, kuri bija vērsi uz to, lai ierobežotu cilvēku kontaktēšanos epidemioloģiski nedrošā vidē. Atklātuma princips tiesas procesā nodrošina to, ka tiesa, spriežot tiesu, nodrošina savu darbību caurskatāmību: rīkojot atklātas tiesas sēdes un nodrošinot nolēmumu publiskumu. Pētnieciskā darba ietvaros autore pēta tiesas spriešanas atklātuma principu, tā un tiesību uz taisnīgu tiesu ievērošanu Covid-19 pandēmijas laikā, analizē Covid-19 pandēmijas ietekmi uz tiesas procesu un vērtē ar to saistītus konkrētus tiesu prakses piemērus. Autore secina, ka vajadzība pēc tiešsaistes pakalpojumiem Covid-19 pandēmijas laikā veicināja straujāku gan e-lietas, gan attālinātā tiesas procesa, gan tehnoloģiskā aprīkojuma izmantošanu tiesā. Tiesai rīkojot tiesas sēdes attālināti var nākties saskarties gan ar tiesas procesu veicinošiem, gan traucējošiem apstākļiem. Vispārīgi vērtējot tiesas sēžu rīkošana attālināti netiek pārkāpts atklātuma princips. Tiesai publicējot ne tikai galīgo tiesas spriedumu, bet arī citus tiesas nolēmumus, kas ir saistīti ar konkrēto lietu, tiek veicināta sabiedrības uzticība tiesai. | |
dc.description.abstract | The right to a fair trial consists of several elements, one of which is the principle of openness of judicial proceedings. During the Covid-19 pandemic, various types of restrictions were imposed, which were aimed at limiting human contact in an epidemiologically unsafe environment. The principle of openness ensures that the court, ensures the transparency of its actions: by holding open court hearings and ensuring that decisions are made public. Within the research work, the author studies the principle of judicial openness, its observance and the right to a fair trial during the Covid-19 pandemic, analyzes the impact of Covid-19 pandemic on the court process and evaluates specific examples of judicial practice related to it. The author concludes that the need for online services during the Covid-19 pandemic contributed to a faster development of e-cases, remote court proceedings and better technological equipment in court. When the court conducts court hearings remotely, it may have to face both facilitating and hindering circumstances of the court process. In general, the holding of court sessions remotely does not violate the principle of openness. When the court publishes not only the final court ruling, but also other court rulings related to the specific case, public trust in the court is promoted. | |
