Resocializācijas ietekme uz noziedzīga nodarījuma recidīvu

Abstract

Maģistra darba temata “Resocializācijas ietekme uz noziedzīga nodarījuma recidīvu” mērķis ir izpētīt resocializācijas jēdzienu un būtību, ģenēzi Latvijas un starptautiskajos tiesību aktos, resocializācijas līdzekļus, aplūkot un raksturot noziedzīga nodarījuma recidīva jēdzienu un būtību, veidus, ietekmējošos faktorus un riskus, kā arī analizēt resocializācijas ietekmi uz noziedzīga nodarījuma recidīva rādītājiem Latvijā desmit gadu griezumā, salīdzinot tos ar Somijas, Lietuvas Republikas un Krievijas Federācijas ieviestajiem resocializācijas pasākumiem un korelāciju ar noziedzīga nodarījuma recidīva rādītājiem. Izvēlētā temata problemātika ir saistīta ar to apstākli, ka notiesāto resocializācijas īstenošanas kārtība Latvijā tiek īstenota kopš 2013. gada 9. aprīļa, proti, vairāk nekā desmit gadus, tomēr noziedzīga nodarījuma recidīva rādītāji Latvijā ir augsti, un tie nav būtiski mainījušies kopš resocializācijas pasākumu ieviešanas Latvijas normatīvajos aktos. Darba ietvaros tiks aplūkota gan Latvijas, gan ārvalstu pieredze veiksmīgu resocializācijas pasākumu realizēšanā, kas ievērojami mazina noziedzīga nodarījuma recidīva rādītājus. Darba izstrādes rezultātā tiks visaptveroši konstatētas problēmas resocializācijas pasākumu īstenošanā, piedāvāti risinājumi un atziņas par faktiskās situācijas uzlabošanu, tai skaitā noziedzīga nodarījuma recidīva skaita samazināšanu. The aim of the Master's thesis topic "The impact of resocialization on the recidivism" is to study the concept and nature of resocialization, its genesis in Latvian and international legal acts, means of resocialization, to examine and characterize the concept and nature of recidivism, types, influencing factors and risks, as well as to analyze resocialization the impact on recidivism rates in Latvia over a ten-year period and compare them with resocialization measures introduced by Finland, Lithuania and the Russian Federation and the correlation with recidivism rates. The problematic of the chosen topic is related to the fact that the procedure for implementing the resocialization of convicts has been implemented in Latvia since April 9, 2013, that is, for more than ten years, however, the rates of recidivism of a criminal offense in Latvia are high and they have not changed significantly since the introduction of resocialization measures in Latvia in regulatory acts. Within the framework of the work, both Latvian and foreign experience in the implementation of successful resocialization measures, which significantly reduce the indicators of recidivism of a criminal offense, will be considered As a result of the development of the work, problems in the implementation of resocialization measures will be comprehensively identified, solutions and insights will be offered for improving the actual situation, including reducing the number of recidivism.
