Abstract

Maģistra darbā “Medicīniska rakstura piespiedu līdzekļi, to noteikšana un procesuālā kārtība” veikts pētījums par praksē pastāvošām normatīvā regulējuma nepilnībām saistībā ar medicīniska rakstura piespiedu līdzekļu piemērošanas, izpildes un izpildes uzraudzības, grozīšanas un atcelšanas aspektiem. Darba pētījumā ir analizēti ar medicīniska rakstura piespiedu līdzekļiem saistītie jēdzieni un citi tiesiskie instrumenti, uzmanību pievēršot pazīmes “bīstama sabiedrībai” izpratnei un nozīmei šī tiesiskā institūta pamatā. Maģistra darba uzdevumi ir apzināt esošos problemātiskos aspektus, kas saistīti ar medicīniska rakstura piespiedu līdzekļu piemērošanu un izpildi, apkopojot dažādus autoru viedokļus, analizējot tiesu praksi, pētot juridiskus avotus, kas tapuši normatīvā regulējuma grozīšanas un tapšanas rezultātā, kā arī analizējot aptaujāto prokuroru sniegto atbilžu rezultātus. Autore darba gaitā ir sniegusi viedokli par vairākiem problēmjautājumiem, tostarp, arī ierosinot dažādus priekšlikumus grozījumiem tiesību normās.

The Master’s Thesis “Compulsory measures of a medical nature, determination thereof and procedural procedures” regarding the deficiencies of the regulatory framework in practice and legal doctrine in relation to the most problematic aspects of supervision, amendment and revocation of the application, enforcement and enforcement of compulsory measures of a medical nature. The work study analyses concepts and other legal instruments related to medical coercive measures, paying particular attention to the understanding and importance of the “dangerous to society” feature at the heart of this legal institute. The purpose of the Master's Thesis is to identify the existing problematic aspects related to the application and enforcement of compulsory measures of a medical nature, compiling different opinions of authors, analysing compilations of laws, studying legal documents resulting from the amendment of the regulatory framework, as well as analysing the results of the answers provided by the surveyed prosecutors. Author has expressed her views on various issues, as well as proposing various proposals for amendments to the legislation.
