Ar 2022.gada 27.oktobra likumu “Grozījumi Krimināllikumā” tika būtiski mainīta kriminālatbildības noteikšana par transportlīdzekļa vadīšanu alkohola vai apreibinošu vielu ietekmē, kas radīja sabiedrībā neapmierinātību un neskaidrības. Pētījuma mērķis ir izpētīt Krimināllikuma 262.pantā un 70.13 panta piektajā daļā ietvertā regulējuma teorētiskos un praktiskos aspektus, problemjautājumus, rast risinājumus regulējuma uzlabošanai. Darba gaitā autore veikusi noziedzīgā nodarījuma sastāva juridisko analīzi, izpētīja tiesu praksi un ārvalstu pieredzi. Pētījuma rezultātā rasta izpratne par Krimināllikuma 262.panta un 70.13 panta piektās daļas regulējumu, tā piemērošanas problēmjautājumiem, piedāvāts esošā regulējuma uzlabojums. On October 27, 2022, the law "Amendments to the Criminal Law" significantly changed the constatation of criminal liability for driving a vehicle under the influence of alcohol or intoxicating substances, which caused dissatisfaction and uncertainty in society. The aim of the study is to explore the theoretical and practical aspects, issues and solutions for improving the regulation contained in Section 262 and the fifth part of Section 70.13 of the Criminal Law. During the research process, the author conducted a legal analysis of the elements of the criminal offense, studied court practice, and reviewed foreign experience. As a result of the study, an understanding of the regulation contained in Section 262 and the fifth part of Section 70.13 of the Criminal Law was obtained, as well as the issues related to its application, and suggestions for improving the existing regulation were proposed.
