Izteiksmes brīvība un juridiskas personas tiesības uz reputācijas aizsardzību
Abstract
Reputācijas aizsardzībai ir bijusi spēcīga nozīme gan senā vēsturē, gan mūsdienās. Lai arī Eiropas Cilvēktiesību un pamatbrīvību aizsardzības konvencijas 8. panta tvērumā ietilpst fizisku personu tiesības uz reputācijas aizsardzību, ir palicis atvērts jautājums par 8. panta tiesību attiecināšanu arī uz juridiskām personām. Maģistra darbā “Izteiksmes brīvība un juridiskas personas tiesības uz reputācijas aizsardzību” autore izvērtē juridisku personu cilvēktiesības, reputācijas aizsardzības un izteiksmes brīvības nozīmi, kā arī tiesību uz reputācijas aizsardzību un izteiksmes brīvības mijiedarbību, pievēršot īpašu uzmanību gadījumiem, kuros ir iesaistīts darbinieks un darba devējs. Analizējot Eiropas Cilvēktiesību tiesas un Latvijas tiesu praksi, kā arī tiesību doktrīnu, autore identificē nesenas judikatūras izmaiņas, viedokļu atšķirības attiecībā uz reputācijas aizsardzības attiecināšanu uz juridiskām personām, kā arī joprojām neatbildētus jautājumus. The protection of reputation has played a strong role in history, as well as nowadays. While Article 8 of the European Convention on Human Rights includes the right to protect an individuals reputation, it remains an open question whether Article 8 rights can be extended to legal persons. In the Master's thesis "Freedom of expression and the right of a legal entity to protection of reputation", the author examines the human rights of legal persons, the importance of protection of reputation and freedom of expression, as well as the interaction between the right to protection of reputation and freedom of expression, paying particular attention to cases involving an employee and an employer. By analysing the case law of the European Court of Human Rights and Latvian courts, as well as legal doctrine, the author identifies recent changes in the case law, differences of opinion regarding the extension of the protection of reputation to legal persons, as well questions that remain unanswered.
