Tiesību teorijas kā studiju kursa attīstība Latvijas teritorijā no 1985. gada līdz 2022. gadam

Abstract

Tiesību teorijas, tostarp tiesību avotu, izpratne ir būtiska tiesību piemērotāju darbībā. Šī izpratne rodas tiesību teorijas studiju kursa laikā, kura saturs mainās laika gaitā un maina arī tiesību piemērotāju izpratni. Darba mērķis ir analizēt korelāciju starp konkrētajā laikā esošā tiesību teorijas studiju kursa saturu, ko docē Latvijas Universitātē, un tiesību izpratni tiesību piemērotāju vidū, ņemot vērā tiesiskās sistēmas izmaiņas 20. gs. 90. gados, kas nav pētīts šādā veidā. Salīdzinot izmaiņas tiesību teorijas studiju kursa un tajā ietverto tiesību avotu mācības saturā un tiesību avotu izpratnes attīstību tiesas spriedumos, attīstība notiek ar laika nobīdi, kā galvenajam tiesību avotam paliekot likumam.

Understanding legal theory, including the sources of law, is essential in the legal practitioners’ operation. This understanding is gained by the study course, the content of which changes over time, changing the understanding of legal practitioners. The thesis aims to analyse the correlation between the legal theory study course’s content at the specific time taught at the University of Latvia and the understanding of the law among law practitioners, considering the changes in the legal system in the 1990s, such research has not been conducted before. Comparing the changes in the content of the legal theory study course, including the sources of law, and the development of the understanding of the sources of law in court judgments since 1985, the development takes place with a time lag, with the law remaining as the main source of law.
