Referendums saistībā ar pašnoteikšanās tiesībām ietver divu būtisku konceptu konfliktu un šābrīža starptautiskā prakse mēdz būt strīdīga. No vienas puses, pašnoteikšanās tiesības, tās īstenojot ar referendumu, ļauj noskaidrot tautas vēlmes demokrātiskā veidā, iespējams, atrisinot ieilgušos konfliktus. No otras puses, teritoriālā integritāte nozīmē valstu robežu nemainīgumu un jau esošās kārtības saglabāšanu. Tā kā referendums var būt tautas pašnoteikšanās līdzeklis neatkarības dibināšanai, pieprasot esošas valsts robežu pārskatīšanu, ir nepieciešama noteiktība neatkarības referendumu gadījumā. Autora ieskatā esošie Venēcijas komisijas izstrādātie kritēriji referendumu rīkošanai ir papildināmi ar noteikta kvoruma (50 %) prasību. Situāciju var palīdzēt risināt arī ANO iesaiste gan pirms referenduma rīkošanas, gan pēc tā, gan tā gaitā, lai nodrošinātu referenduma tiesiskumu un pēc iespējas lielāku atbalstu starptautiskā līmenī. Uzmanības lokā ir jābūt arī etnisko minoritāšu tiesību aizsardzībai. The referendum in the context of the right to self-determination involves a conflict between two important concepts. The current international practice is sometimes controversial. On the one hand, the right to self-determination, when implemented through a referendum, allows for the democratic clarification of the wishes of the people and thus the resolution of protracted conflicts. On the other hand, territorial integrity is about not changing the borders of countries and maintaining the already existing order without changing anything. Considering that a referendum can be a means of self-determination by the people for the establishment of independence and thus may require a revision of the borders of an existing state, there is a need for certainty when an independence referendum is pending. In the author's view, the existing criteria developed by the Venice Commission for holding referendums should be supplemented by the requirement of a certain quorum - 50%. The situation can also be resolved by involving the UN before, after, and during the holding of the referendum to ensure its legitimacy and maximum support from the perspective of the international community. Attention should also be paid to the protection of ethnic minority rights.
