Klimata pārmaiņu radīts cilvēktiesību aizskārums kā pamats tiesvedībai Eiropas Cilvēktiesību tiesā un Eiropas Savienības Tiesā

Abstract

Bakalaura darbā analizētas klimata pārmaiņu radītās sekas kā potenciāls cilvēktiesību aizskārums un ar šo aizskārumu pamatotas prasības iespējas tikt pieņemtai izskatīšanai Eiropas Cilvēktiesību tiesā un Eiropas Savienības Tiesā. Pētījuma ietvaros aplūkota dažāda veida klimata tiesvedību vēsturiskā attīstība, kā arī aktuālās tendences šī cilvēktiesību aizskāruma izpratnē. Balstoties uz pirmajā nodaļā veikto teorētisko apkopojumu, otrajā un trešajā nodaļā tā gaismā analizēta līdzšinējā prakse un iespējas ierosināt tiesvedību Eiropas Cilvēktiesību tiesā un Eiropas Savienības Tiesā. Darbā izdarīti secinājumi par šo starptautisko tiesu lomu kā aizsardzības mehānismiem pret klimata pārmaiņu ietekmi uz cilvēktiesībām.

The thesis analyses the effects of climate change as a potential violation of human rights and the admissibility of a claim based on such a violation before the European Court of Human Rights and the Court of Justice of the European Union. The study examines the historical development of different types of climate litigation, as well as current trends in the understanding of this particular human rights violation. In the light of the theoretical conclusions made in the first chapter, the second and third chapter of this thesis analyse the current practice and possibilities of bringing proceedings before the European Court of Human Rights and the Court of Justice of the European Union. The paper concludes on the role of these international courts as protection mechanisms against the human rights impacts of climate change.
