Ar noziedzīga nodarījumu saistītas mantas konfiskācija un tās aizstāšana

Abstract

Bakalaura darbā analizēts mantas īpašās konfiskācijas ietvars, atsevišķi izvēršot sadaļas par mantas konfiskāciju un tās aizstāšanu, kas ir saistīta ar noziedzīgu nodarījumu, uzsverot šobrīd esošos problēmjautājumus tieši saistībā ar transportlīdzekļa kā ar noziedzīgu nodarījumu saistītas mantas konfiskāciju un to aizstāšanu. Darba ietvaros tika analizēta tiesu prakse Latvijā un ārvalstīs, aplūkota vēsturiskā attīstība, pētīta juridiskā literatūra kā arī piedāvāti alternatīvi risinājumi.

The bachelor’s thesis analyses the specific confiscation framework of property, distinguishing separately sections on confiscation of property and its substitution, which is linked to a criminal offence. Highlighting the current issues directly related to vehicle forfeiture in relation to the confiscation of property related to criminal offences and their substitution. In the framework of the thesis, the practice of courts in Latvia and abroad were analyzed, the historical development was examined, legal literature was studied as well as alternative solutions were offered.
