Karavīru disciplināratbildības piemērošanas problēmas

Abstract

Ar Militārās disciplināratbildības likuma spēkā stāšanos 2020. gadā spēku zaudēja Karavīru un zemessargu militārās disciplīnas reglaments. Jaunais regulējums ietver arī tās tiesību normas, kas bija ietvertas arī iepriekšējos tiesību aktos. Bakalaura darba mērķis ir izpētīt un noskaidrot, vai visu iepriekš pastāvējušo tiesību normu ietveršana jaunajā likumā ir bijusi mērķtiecīga, lai pilnīgāk spētu regulēt karavīru disciplināratbildības jautājumus, vai arī, pieņemot jauno likumu, tās ir pārņemtas vien inerces pēc un nesekmē likuma mērķa sasniegšanu. Bakalaura darba mērķa sasniegšanai autore pēta disciplināratbildības regulējumu Militārā dienesta likumā un tiesu praksi.

With the entry into force of the Military Disciplinary Liability Law in year 2020 the Rules of Procedure for the Soldier and National Guardsmen Military Discipline is no longer in force. The new rules of procedure includes the same laws, that were included in previous Laws and Regulations. The purpose of Bachelor’s Thesis is to research and conclude if the inclusion all of the previous laws has been targeted to be able to fully regulate soldiers disciplinary liability or by passing a new law, they were approved by inertia alone and did not contribute to the purpose of the law. To achieve the goal of the Bachelor’s Thesis, the author is researching the rules of procedures for disciplinary liability in Military Service Law and law practice.
