Rakstveida pierādījumu iesniegšana, attiecināmība un pieļaujamība civilprocesā

Abstract

Bakalaura darba tēma ir ‘’Rakstveida pierādījumu iesniegšana, pieļaujamība un attiecināmība civilprocesā’’. Rakstveida pierādījumi ir viens no būtiskākajiem pierādīšanas līdzekļiem civilprocesā. Izmantojot rakstveida pierādījumus, lietas dalībniekiem ir iespēja pamatot un pierādīt tos prasījumus un iebildumus, kurus tie izvirza procesa laikā, taču tiesai pamatojoties uz dalībnieku iesniegtajiem pierādījumiem ir pienākums taisīt tiesisku un pamatotu spriedumu. Bakalaura darbā tiks aplūkotas un analizētas Latvijas Civilprocesa likuma normas attiecībā uz rakstveida pierādījumiem, to pieļaujamību un attiecināmību, kā arī tiesu prakse, papildus Latvijas regulējumam, tiks aplūkots arī Igaunijas, Lietuvas un Vācijas civilprocesuālais regulējums attiecībā uz rakstveida pierādījumiem. Darba mērķis ir aplūkot gan Latvijas, gan citu valstu Civilprocesa likuma normas attiecībā uz rakstveida pierādījumiem, to pieļaujamību un attiecināmību, un piedāvāt priekšlikumus Latvijas Civilprocesa likuma pilnveidošanai tieši attiecībā uz rakstveida pierādījumiem.

The subject of Bachelor’s thesis is submission, admissibility and eligibility of written evidence is civil proceedings. Written evidence in civil procedure is one of the most important things of proof. Using written evidence in civil procedures, both parties have the opportunity to substantiate and prove the claims and objections which they raise during the proceedings, but the court is under the obligation to give a legal and reasoned judgement on the basis of the evidence provided by the parties. The Bachelor’s thesis will inspect and analyse the provisions of the Latvian Civil Procedure Law in relation to written evidence, its admissibility and eligibility, as well as the case law, in addition to the Latvian regulations, will also inspect the civil procedural rules of Estonia, Lithuania and Germany in relation to written evidence. The purpose of the thesis is to look at the provisions of the Civil Procedure Law of both Latvia and other States in relation to written evidence, its permissibility and eligibility, and to offer proposals for improvement of the Latvian Civil Procedure Law directly in relation to written evidence.
