Nepamatoti lēta piedāvājuma noraidīšanas problemātika publiskajos iepirkumos

Abstract

Bakalaura darba tēma ir “Nepamatoti lēta piedāvājuma noraidīšanas problemātika publiskajā iepirkumā”. Tēma ir aktuāla, jo publiskajos iepirkumos pastāv strīdi par to, vai piedāvājums ir nepamatoti lēts. Par to liecina juridiskās prakses apmērs. Bakalaura darba mērķis ir analizēt nepamatoti lēta piedāvājuma institūta normatīvo regulējumu un prakses materiālus, konstatēt sastopamo problemātiku un izvirzīt priekšlikumus konstatēto trūkumu novēršanai. Pētījuma rezultātā secināts, ka normatīvajos aktos nav definēts nepamatoti lēts piedāvājums. Pasūtītājam ir pienākums piedāvājumu noraidīt, ja tas šķiet nepamatoti lēts. Normatīvajos aktos nav testa nepamatoti lēta piedāvājuma identificēšanai. Ja pasūtītājam rodas aizdomas, ka piedāvājums varētu nebūt īsts, tam ir jāprasa pretendentam paskaidrojumi par cenu vai izmaksu veidošanās mehānismu.

The subject of the Bachelor's thesis is "Problems of rejecting abnormally low tenders in public procurement". The theme is topical as there are often situations in public procurement processes that give rise to disputes as to whether a tender is abnormally low. This is evidenced by the huge amount of legal practices The aim of the bachelor's thesis is to analyze the institute of regulatory framework and practice of materials with an abnormally low tenders, to identify the encountered problems and to put forward proposals for the elimination of the identified shortcomings. As a result of the research, it was concluded that an abnormally low tenders is not defined in the regulatory acts. The contracting authority is obliged to reject the offer if it seems abnormally low. Normative acts do not have a test for identifying an abnormally low tender. If the contracting authority suspects that the offer might not be real, the contracting authority must ask the tenderer for explanations about the price or cost formation mechanism.
