Atsevišķi pierādīšanas un pierādījumu aspekti saistībā ar mantas izcelsmi kriminālprocesā un procesā par noziedzīgi iegūtu mantu

Abstract

Bakalaura darba mērķis ir izpētīt mantas izcelsmes pierādīšanas regulējuma efektivitāti, piemērošanas problemātiku un pilnveidošanas iespējas. Šī darba ietvaros autors analizē Latvijas Republikas, Eiropas Savienības un starptautiskos normatīvos aktus un tiesu praksi, ieteikumu tiesības un doktrinālos avotus. Kā būtiskākos pētāmos jautājumus, par kuriem izdarīt secinājumus vienveidīgas prakses sekmēšanai un ierosināt priekšlikumus tiesiskā regulējuma pilnveidošanai, autors izvēlējies: (1) mantas izcelsmes pierādīšanas prasības atkarībā no noziedzīgi iegūtas mantas veida; (2) mantas izcelsmes pierādīšanas prasības noziedzīgi iegūtu līdzekļu legalizēšanas gadījumos; (3) pierādījumu un to pārbaudes problemātika procesā par noziedzīgi iegūtu mantu.

The purpose of the Bachelor Thesis is to study the effectiveness, application and improvement possibilities of the legal framework when proving the origin of property. Within the course of this paper the author analyses regulatory acts and judicial practice of the Republic of Latvia, European Union and international ones, soft law and doctrinal sources. The author has chosen the following as the most important issues to be researched, on which to draw conclusions for the promotion of uniform practice and propose improvements of the legal framework: (1) the requirements of proving the origin of the property, depending on the type of criminally obtained property; (2) proving of the origin of property in cases of money laundering; (3) problems regarding evidence and its verification in proceedings regarding criminally acquired property.
