Kriminālatbildības par noziedzīgi iegūtu līdzekļu legalizāciju piemērošanas problēmas Latvijā

Abstract

Mūsdienās viena no aktuālākajām problēmām gan pasaulē, gan Latvijā ir noziedzīgi iegūtu līdzekļu legalizācija. Pasaules mērogā tiek aplēsts, ka ik gadu 2 – 5% no kopējā iekšzemes kopprodukta jeb 800 miljardi – 2 triljoni ASV dolāru ir noziedzīgi iegūti līdzekļi, taču kopējais apmērs nav skaidri nosakāms, ņemot vērā, neatklāto noziegumu skaitu.Autors izvēlējās šādu darba tēmu, jo noziedzīgi iegūtu līdzekļu legalizācija, rada būtiskas ekonomikas, sociālas un politiskas sekas ne tikai Latvijas mērogā, bet arī visā pasaulē, tāpēc ir nepieciešams izpētīt un atklāt nozieguma būtību un problemātiku, lai efektīvāk cīnītos ar noziedzīgi iegūtu līdzekļu legalizāciju.Bakalaura darba mērķis ir veikt noziedzīgi iegūtu līdzekļu legalizācijas sastāva analīzi, kā arī aplūkot būtiskākos praktiskos un teorētiskos problēmjautājumus. One of the most pressing issues both globally and in Latvia today is the laundering of illegally acquired funds. It is estimated that worldwide, 2-5% of the gross domestic product, or 800 billion to 2 trillion US dollars, constitutes proceeds from criminal activities, although the total amount is difficult to determine precisely due to the undisclosed number of crimes.The author chose this topic for the thesis because the laundering of illegally acquired funds has significant economic, social, and political consequences not only on a national scale but also worldwide. Therefore, it is necessary to research and uncover the nature and problems associated with this crime in order to effectively combat the laundering of illegally acquired funds.The aim of the bachelor's thesis is to conduct an analysis of the composition of money laundering from criminal activities and examine the key practical and theoretical issues.Keywords: money laundering, Section 195 of the Criminal Law, prevention of money laundering, illegally acquired funds.
