Darba mērķis ir izpētīt komercdarbības ierobežojumu samērīgumu Covid-19 ārkārtējās situācijas apstākļos. Ierobežotā apjoma dēļ tiks pētīti ierobežojumi tikai sabiedriskās ēdināšanas jomā. Galvenie pētāmie jautājumi ir, vai Latvijā Covid-19 laikā noteiktie ierobežojumi attiecībā uz komercdarbību ir samērīgi un vai pastāv risinājumi, kas mazāk ierobežotu pamattiesības. Darba rezultāti liecina, ka aplūkotais ierobežojums sabiedriskās ēdināšanas jomā ir samērīgs. Ņemot vērā šī darba novitāti un to, ka par šo jautājumu vēl nav iepriekš bijuši pētījumi, autors izvirzīja vairākus ieteikumus, kā efektīvāk noteikt ierobežojumus ārkārtējās situācijas laikā un panākt mazāku ietekmi uz pamattiesībām. Kā galvenos autors min ierobežojuma izpratnes veidošanu un vadlīniju izstrādi to īstenošanai; stratēģiskās komunikācijas uzlabošanu starp valdību un sabiedrību; ārkārtējās situācijas regulējuma stiprināšanu. The aim of the work is to investigate the proportionality of commercial activity restrictions under the conditions of the Covid-19 emergency. Due to the limited scope, only catering restrictions will be explored. The main questions to be investigated are whether the restrictions set in Latvia in Covid-19 emergency regarding commercial activity are proportionate and whether there are solutions that would limit fundamental rights less. The results of the work show that the considered restriction in the field of public catering is proportionate. Considering the novelty of this work and the fact that there have been no previous studies on this issue, the author put forward several recommendations on how to set restrictions more effectively during an emergency and achieve less impact on fundamental rights. As the main recommendations, the author mentions the creation of awareness of the limitation and developing guidelines for their implementation; improving strategic communication between government and society; strengthening emergency regulation.
