Vārda brīvības un naida runas robežas

Abstract

Ikvienas demokrātiskas valsts pamats ir sabiedrība. Sabiedrība, kura aktīvi iesaistās valsts procesos un attīstībā. Lai sabiedrības locekļi varētu pilnvērtīgi iesaistīties un palīdzēt, tiem jāspēj domāt patstāvīgi, izteikt savus uzskatus un sludināt savas idejas, kā arī būt informētiem par notiekošo. Tiesības uz vārda brīvību ir ārkārtīgi būtiskas personas pamattiesības, kas nepieciešamas ikvienam demokrātiskas sabiedrības loceklim. Vārda brīvība veicina viedokļu dažādību un sabiedrības izglītotību. Šajās tiesības ietilpst vairākas personu brīvības, taču darba ietvaros, autors pētīja tikai tiesības izpaust savus uzskatus un idejas. Izpētot judikatūras un doktrīnas avotus, darba autors konstatēja, ka tiesības uz vārda brīvību nav absolūtas un tās var tikt ierobežotas, lai sasniegtu kādu svarīgāku mērķi vai aizsargātu būtiskākas tiesības. Vārda brīvība neaprobežojas tikai ar viedokļiem, kuri ir sabiedrībā vispārpieņemti un atzīti, šīs tiesības aizsargā arī personas tiesības izteikt viedokļus, kuri šokē vai pat aizskar. Tomēr vārda brīvības tiesības nesniedz personām tiesības izpaust naida runu, taču robeža starp vārda brīvību un naida runu ir ļoti smalka un ne vienmēr skaidra. Pirmajā nodaļā autors izzināja tiesību uz vārda brīvību saturu un tiesisko regulējumu. Otrajā nodaļā tika izpētīts kā un kādos gadījumos var tikt ierobežotas personas tiesības uz vārda brīvību. Trešajā nodaļā autors izpētīja jēdziena “naida runa” saturu, nošķiršanu no tiesībām uz vārda brīvību un īpaši pievērsās naida runas izpausmēm par kara noziegumiem. Bakalaura darbs sastāv no anotācijas latviešu un angļu valodās, satura rādītāja, ievada, trīs nodaļām, kopsavilkuma un izmantoto avotu saraksta. Darba kopējais apjoms ir 46 lapaspuses.

Society is the foundation of every democratic country. A society that actively participates in the country's processes and development. To participate and contribute fully, members of society need to be able to think independently, to express their views and ideas, and to be informed about what is happening. The right to freedom of expression is a fundamental personal right that is essential for everyone in a democratic society. Freedom of expression contribute to diversity of opinion and to well educated society. This right includes multiple freedoms, but in this thesis, author researched only the right to express one’s views and ideas. After researching the judicature and doctrine, author concluded that freedom of expression is not an absolute human right and can be restricted to achieve a more important goal or to protect more important rights. Freedom of expression is not limited only to opinions that are generally accepted, these rights also protect opinions that shock or even offend. However freedom of expression does not give the right to express hate speech, but the line between the right to express one's views and hate speech is fine and not always clear. In the first chapter, the author explored the content and legal framework of the right to freedom of expression. The second chapter examined how and in what cases a person's right to freedom of expression may be restricted. In the third chapter, the author explored the content of the concept of hate speech, its distinction from the right to freedom of expression, and focused in particular on hate speech manifestations of war crimes. Bachelor thesis consists of annotation in latvian and english languages, table of contents, introduction, three chapters, summary and list of used sources. The total length of the work is 46 pages.
