Augstākās izglītības ieguve kā administratīvais process

Abstract

Bakalaura darbā “Augstākās izglītības ieguve kā administratīvais process” tiek pētīta augstākās izglītības ieguves procesa esība publiski tiesisko attiecību regulējuma un administratīvā procesa ietvarā. Augstākās izglītības ieguve ir specifisks administratīvais process, jo augstākās izglītības ieguves laikā studējošais vienlaikus ir gan iestādei īpaši pakļauta persona, gan publisko tiesību līguma subjekts, radot duālismu augstskolas un studējošā tiesiskajās attiecībās. Autors secina, ka augstākās izglītības ieguve kā administratīvais process vairākos aspektos saduras ar vispārējiem administratīvā procesa un valsts pārvaldes darbības noteikumiem.

The bachelor's thesis “Obtaining higher education as an administrative procedure” examines the process of obtaining higher education within the the legal framework of public legal relations and administrative procedural rules. Obtaining higher education is a specific administrative procedure, because during the acquisition of higher education, the student is subordinate to the university and the subject of a public law contract at the same time, creating a dualism in the legal relationship between the university and the student. The author concludes that the obtainment of higher education as an administrative procedure collides with the general rules of the administrative procedure and state administration in several aspects
