Valsts pienākumi sociālo un ekonomisko tiesību īstenošanā

Abstract

Sociālo un ekonomisko tiesību īstenošana ir ievērojami atkarīga no valstij pieejamiem resursiem. Ņemot vērā, ka resursu sadalīšana ir politisks jautājums, valstij šo tiesību īstenošanā ir piešķirta plaša rīcības brīvība. Tomēr valstis ne vienmēr tām piešķirto rīcības brīvību izmanto godprātīgi vai pārdomāti. Līdz ar to darbā tika pētīts, kā tiek ierobežota valsts rīcības brīvība, nosakot pienākumus šo tiesību īstenošanā, sevišķi pētot valsts rīcības brīvību attiecīgu pienākumu pildīšanā un tās ietekmi uz sociālajām un ekonomiskajām tiesībām. Kaut arī ir panākts progress, nosakot pienākumu saturu, jāsecina, ka joprojām trūkst konkrētības, vērtējot vai valsts ir īstenojusi pienākumus sociālo un ekonomisko tiesību īstenošanā, kas ir nepieciešama, lai sociālās un ekonomiskās tiesības būtu efektīvas un darbotos tā, kā tas ir paredzēts.

The implementation of social and economic rights depends significantly on the resources available to the State. Given that the allocation of resources is a political issue, the State has a wide discretion in implementing these rights. However, States do not always exercise their discretion in good faith or thoughtfully. This study explores how the national discretion is limited by imposing obligations in the implementation of these rights, in particular by examining the national discretion in the performance of the duties in question and its impact on social and economic rights. While progress has been made in defining the content of the obligations, it must be concluded that there is still a lack of specificity in assessing whether the State has fulfilled the obligations to implement social and economic rights that is necessary for social and economic rights to be effective and to function as intended.
