Pretendenta tehnisko un profesionālo spēju noteikšana un izvērtēšana publiskajā iepirkumā

Abstract

Bakalaura darba mērķis ir izpētīt problēmas, kas rodas, pasūtītājam, nosakot un izvērtējot pretendenta tehnisko un profesionālo spējas un piedāvāt atbilstošos risinājumus to atrisināšanai. Tēmas aktualitāti apliecina Iepirkumu uzraudzības biroja statistika par iepirkumu procedūru pārkāpumiem. Pētījuma rezultātā secināts, ka publisko iepirkumu jomas normatīvajā regulējumā pastāv vairāki robi, kurus būtu jānovērš, piemēram, nav detalizētu vadlīniju vai skaidrojumu par piedāvājumu vērtēšanu, netiek paredzēts iepirkuma dokumentācijā iekļaut prasības kā pretendenti, kuri pieredzi ieguvuši personu apvienības vai personālsabiedrības sastāvā, var apliecināt savas spējas.

The aim of the bachelor's thesis is to investigate the problems that arise for the customer, determining and evaluating the technical and professional abilities of the applicant and to offer appropriate solutions for their solution. The topicality of the thesis’s topic is confirmed by the statistics of the Procurement Monitoring Bureau on violations of procurement procedures. As a result of the study, it was concluded that there are several gaps in the public procurement regulation, which should be prevented, for example, there are no detailed guidelines or explanations on the evaluation of offers, it is not obligatory to include requirements in the procurement documentation regarding how tenderer’s, who have gained experience as part of an association of individuals or a partnership, can proof their abilities.
