Bakalaura darba mērķis ir veikt darba tiesību institūtu – gan konkurences ierobežojuma, gan komercnoslēpuma neizpaušanas pienākuma teorētisko izpēti un attiecīgās tiesu prakses analīzi. Darbā sniegti priekšlikumi un secinājumi gan, lai novērstu tiesu praksē novēroto tendenci noslēgt konkurences ierobežojumus uz maksimālo termiņu, paredzot par to niecīgu atlīdzību, tādējādi pārmērīgi ierobežojot darbinieka tiesības uz turpmāko profesionālo darbību, gan arī, lai iespējami atrisinātu tiesu praksē novēroto pretrunu attiecībā uz komercnoslēpuma neizpaušanas pienākuma termiņu. Papildus tam tiek apskatīts “atbilstošas atlīdzības” apmērs, kritēriji tās noteikšanai un izmaksas kārtība. Bakalaura darba ietvaros tiek izvirzīts priekšlikums apsvērt Darba likuma grozījumus saistībā ar konkurences ierobežojumu, paredzot atšķirīgus būtisko sastāvdaļu limitus, balstoties uz darbinieka veicamo pienākumu saturu. The aim of the Bachelor's thesis is to carry out theoretical research of the legal framework surrounding labour law, specifically concerning both the restriction of competition and the obligation of non-disclosure of trade secrets, as well as to analyse the relevant court practice. The thesis provides proposals and conclusions in order to prevent the observed tendency in court practice to conclude restrictions of competition for the maximum term, providing insignificant compensation for it, thereby excessively restricting the employee's rights to further professional activity, as well as to possibly resolve the contradiction observed in court practice regarding the term of the obligation of non-disclosure of trade secrets. In addition, the amount of "appropriate compensation", criteria for determining it, and the procedure for its payment are examined. Within the framework of the bachelor’s thesis, a proposal is put forward to consider amendments to the Labour Law in relation to restrictions of competition, providing for different limits of essential components based on the nature of the employee's job duties.
