Ar noziedzīgu nodarījumu saistītas mantas konfiskācija

Abstract

Bakalaura darbs veltīts ar noziedzīgu nodarījumu saistītas mantas konfiskācijai. Tas ir viens no mantas īpašās konfiskācijas veidiem, kas reglamentēts Krimināllikuma VIII2 nodaļā. Lielu sabiedrības interesi par šo konfiskācijas veidu izraisījuši grozījumi, kas stājās spēkā 2022. gada 25. novembrī un papildināja Krimināllikuma 70.13 pantu ar obligātu transportlīdzekļa konfiskāciju. Darba mērķis ir apskatīt ar noziedzīgu nodarījumu saistītas mantas konfiskācijas regulējuma attīstību un veikto grozījumu pamatojumu, padziļināti pētīt tā būtību un rast priekšlikumus regulējuma uzlabošanai. Mērķa sasniegšanai tiks aplūkots Latvijas tiesiskais regulējums, juridiskā literatūra, tiesu prakse un veikts salīdzinājums ar ārvalstu regulējumu.

The Bachelor's work is dedicated to the confiscation of property related to a criminal offense. It is one of the forms of special confiscation of property regulated in Chapter VIII2 of the Criminal Law. The public interest in this form of confiscation was caused by the amendments that entered into force on 25 November, 2022 and supplemented Section 70.13 of the Criminal Law with mandatory confiscation of the vehicle. The aim of the work is to examine the development of the regulation on confiscation of property related to a criminal offense and the justification for the amendments made, to study it’s nature in depth and to find proposals to improve the framework. In order to achieve this goal, Latvia’s legal framework, legal literature, court practice will be examined and a comparison with foreign legislation will be made.
