Labas ticības principa nozīme tiesiskās aizsardzības procesā

Abstract

Ņemot vērā to, ka tiesiskās aizsardzības procesa primārais mērķis ir labu ticību ievērojoša parādnieka maksātspējas atjaunošana un ka ar katru gadu arvien pieaug ierosināto, bet sarūk pasludināto tiesiskās aizsardzības procesu skaits, tapis šis bakalaura darbs ar mērķi noskaidrot labas ticības principa nozīmi efektīvā tiesiskās aizsardzības procesa norisē. Darbs ietver arī 2023.gadā veikto grozījumu Maksātnespējas likumā ietekmi uz labas ticības principa ievērošanas un tiesiskās aizsardzības procesa efektivitātes veicināšanu. Vērtēts arī procesā iesaistīto personu pienākums ievērot labas ticības principu procesa norises laikā, iespējamie negodprātīgas rīcības veidi un sekas labas ticības neievērošanai tiesiskās aizsardzības procesā.

Considering that the primary goal of the legal protection process is the restoration of solvency of a bona fide debtor and that the number of initiated legal protection processes is increasing every year while the number of declared processes are decreasing, this bachelor’s thesis was created with the aim of clarifying the importance of the principle of good faith for assuring an effective legal protection process. The thesis also includes the effects of the amendments made in 2023 to the insolvency law on following the good faith principle and on promoting the efficiency of the legal protection process. The thesis also contains the obligation of the persons involved in the legal protection process to follow the good faith principle, possible forms of dishonest behaviour in the process and the possible consequences for not abiding the good faith principle.
