Konvencijas par starptautiskajiem preču pirkuma-pārdevuma līgumiem piemērošana gaisa un ūdens transporta kuģu tirdzniecībā

Abstract

Konvencijas izmantošanā viena no aktuālām problēmām ir vienveidīga interpretācija un piemērošana, kas veicinātu noteiktību, paredzamību un attīstību starptautiskajā tirdzniecībā. Bakalaura darba mērķis ir padziļināti izpētīt Konvencijas 2(e) panta, ar kuru tiek izslēgtas noteiktu kategoriju preces no Konvencijas tvēruma, interpretāciju un piemērošanu starptautiskajā tirdzniecībā un tiesu praksē. Bakalaura darbā galvenokārt tiek pētīts kādas preces (gaisa un ūdens transporta kuģi) un kādēļ tās tiek izslēgtas no Konvencijas. Darba ietvaros tiek veikta analīze, pamatojoties uz 2(e) panta saturu un piemērošanas praksi. Tiek apskatīti problemātiskie aspekti un hipotētiski risinājumi panta vienveidīgai piemērošanai.

One of the current problems in the use of the Convention is uniform interpretation and application, which would promote certainty, predictability and development in international trade. The aim of the bachelor’s thesis is to examine in depth the interpretation and application of Article 2(e) of the Convention, which excludes certain categories of goods from the scope of the Convention, in international trade and jurisprudence. The bachelor’s thesis mainly examines which goods (ships and aircraft) are excluded from the Convention and why. The thesis analyses the content and application practices of Article 2(e). Problematic aspects and hypothetical solutions for an uniform application of the Article are discussed.
