Attālinātā darba tiesiskie aspekti

Abstract

Bakalaura darbā tiek pētīts attālinātais darbs, tā tiesiskais regulējums Latvijā un ārvalstīs un tiesu prakse. Apskatīts attālinātais darbs vēsturiskā skatījumā un attīstībā, kā arī tiek pētītas iespējamās problēmsituācijas saistībā ar šo, un attiecīgi piedāvāti iespējamie risinājumi. Bakalaura darba mērķis ir noskaidrot attālinātā darba tiesiskās iespējas, lai attālinātā darbā iesaistītajiem pēc iespējas mazinātu riskus, kas saistīti ar attālinātā darba veikšanu. Bakalaura darba rezultātā autors ir nonācis pie secinājuma, ka svarīgākais ilgtermiņa attālinātā darba tiesisko attiecību nodrošināšanā ir pirms attālinātā darba uzsākšanas iespējamo risku izvērtēšana gan darba devējam, gan darbiniekam, un, noslēdzot rakstveida vienošanos par attālinātā darba veikšanu, tajā iespējami precīzāk rakstveidā atspoguļot nosacījumus, kas dos pamatu izvairīties no domstarpībām attālinātā darba veikšanas laikā.

The bachelor thesis examines remote work, its legal regulation in Latvia and abroad, and case law. It presents the historical perspective and development of remote work, examines the possible problem situations related to it, and proposes possible solutions. The aim of the bachelor thesis is to clarify the legal possibilities of remote work in order to minimise the risks associated with remote work for those involved in remote work. As a result of the bachelor thesis, the author has come to the conclusion that the most important thing in ensuring a long-term remote working relationship is to assess the potential risks for both the employer and the employee before starting remote work and, when concluding a written agreement on remote working, to specify in writing as precisely as possible the conditions which will make it possible to avoid disputes during remote working.
