Tulks kriminālprocesā

Abstract

Šajā darbā tiek aplūkota mutiskā tulkojuma nozīmē personas tiesību uz taisnīgu tiesu nodrošināšanā kriminālprocesā. Nereti nākas konstatēt, ka tiesības uz tulkojumu tiek upurētas pārējo elementu vārdā, kas veido tiesības uz taisnīgu tiesu. Darbā pausta nostāja, ka tiesības uz taisnīgu tiesu ir nodrošinātas tikai tad, ja visi šo principu veidojošie elementi tiek īstenoti atbilstoši. Darbā tiek aplūkots tiesību uz mutisko tulkojumu regulējums Latvijas Republikas Kriminālprocesa likumā, kontekstualizējot to ar ECT judikatūras atziņām. Darba rezultātā ir identificētas iespējas regulējumu par tiesībām uz tulkojumu KPL uzlabot. This paper entitled “The Role of Interpreter in Criminal Proceedings” deals with the importance of the right to interpreter in ensuring the right to fair trial in criminal proceedings. Often the right to interpreter is sacrificed to overall evaluation of the fairness of the trial as stipulated in article 6 of the European Convention of Human Rights and whether the national courts have done adequate balancing of some components versus the others. Yet, the paper insists, the overall fairness is dependent on fairness of each and every component of the constitutive elements thereof. More specifically the paper deals with the Criminal Procedure Act (CPA) of the Republic of Latvia and rules on the interpreter therein. The authors finds certain discrepancies between the Latvian CPA and the standard set by the ECHR. Keywords: interpreter, criminal proceedings, right to fair trial, Latvian Criminal Procedure Act.
