Civiltiesiskajā apgrozībā biežas ir tādas situācijas, kurās ir dažādi šķēršļi līguma noslēgšanai, bet darījuma dalībnieki jau šajā posmā apzinās, ka grib noslēgt iecerēto līgumu. Šādās situācijās līdzēji var noslēgt priekšlīgumu, ar kuru tiesiskā darījuma dalībnieki vienojas nākotnē uzņemties galvenā līguma saistības. Iespēja piespiedu kārtā panākt priekšlīguma izpildīšanu padara šādu līguma konstrukciju par pievilcīgu darījuma dalībniekiem. Bakalaura darba mērķis: analizēt priekšlīguma tiesiskās sekas. Lai saprastu priekšlīguma nozīmi, autore izvirza šādus uzdevumus: salīdzināt priekšlīguma tiesiskās sekas Latvijā un citur pasaulē, kā arī raksturot priekšlīguma tiesu praksē biežāk sastopamās tiesiskās sekas. Atslēgvārdi: priekšlīgums, priekšlīguma piespiedu izpilde, priekšlīguma transformācija par galveno līgumu. It is common to observe different situations in Civil Law that particular issues may appear when signing an agreement whereas the parties acknowledge at that point that they are likely to approve the agreement. Thus, in these circumstances it is offered to enter a preliminary agreement which allows to legally agree upon the main terms of agreement between parties. The aspect of enforced fulfilment of contractual obligation followed by such agreement is beneficial and desirable for both parties. The goal of this paper is to analyse the legal consequences when signing a preliminary agreement. To identify the importance of a preliminary agreement, the author of this paper highlights the following research tasks: • to differentiate the legal consequences when signing a preliminary agreement in Latvia and other parts of the world. • to define what are the most common legal consequences encountered in the courtrooms when signing a preliminary agreement.
