Labas ticības principa izpratne un pielietojums mūsdienu attiecības

Abstract

Bakalaura darba “Labas ticības principa izpratne un pielietojums mūsdienu tiesībās” galvenais mērķis ir izpētīt un atklāt labas ticības jēdziena saturu mūsdienu civiltiesībās gan Civillikumā, gan ārpus tā, veicinot izpratni par šo principu un tā pareizu lietojumu, kā arī par tiesību institūtiem, kuri ir “izauguši” no labas ticības principa un ir nostiprināmi patstāvīgi vai citiem ar labu ticību saistītiem tiesību institūtiem. Darbā tiek atklāta un izpētīta gan labas ticības principa būtība vispārīgi, gan pētītas dažādas aktualitātes labas ticības kontekstā, piemēram, apstākļu izmaiņu klauzulas konkretizēšana un nostiprināšana Civillikumā, kā arī labas ticības un labticības jēdzienu savstarpējā sasaiste, un no tās izrietošā labticīga ieguvēja aizsardzība. Norādītā mērķa sasniegšanai darbā tiek detalizēti izpētīts un analizēts labas ticības regulējums, likumdošanas procesa materiāli, tiesu prakse, kā arī doktrīna.

The main aim of the bachelor thesis “Understanding and application of the principle of good faith in modern law” is to explore and reveal the content of the concept of good faith in modern civil law, both within and outside the Civil Code, promoting the understanding of this principle and its correct use, as well as of the legal institutions that have "grown" out of the principle of good faith and are to be established independently or in other legal institutions related to good faith. This work reveals and explores both the essence of the principle of good faith in general and various topical issues in the context of good faith, such as the concretization and strengthening of the change of circumstances clause in the Civil Code, as well as the interconnection between the concepts of subjective good faith and objective good faith and the resulting protection of the good faith beneficiary. In order to achieve the stated objective, the thesis examines and analyses in detail the good faith framework, legislative materials, case-law and doctrine.
