Valsts atbalsta pasākumi un tiesību aizsardzība personu ar invaliditāti nodarbinātības veicināšanai

Abstract

Maģistra darbā ir pētīti valsts atbalsta pasākumi un tiesību aizsardzība personu ar invaliditāti nodarbinātības veicināšanai Latvijā. Tēmas aktualitāte noteikta, ņemot vērā joprojām zemo sabiedrības informētību un izpratni par personām ar invaliditāti pieejamo atbalstu nodarbinātībai un tiesību aizsargājošajām normām darba tiesībās. Temata aktualitāti pamato arī dati par sabiedrības novecošanos un ES kontekstā Latvijas iedzīvotāju slikto veselības stāvokli, kas tuvākajā nākotnē varētu palielināt atbalstāmo personu skaitu darbspējas vecumā. Darbā īpaši analizēts valsts atbalsts personu ar invaliditāti nodarbinātības veicināšanai aktīvo nodarbinātības pasākumu ietvaros, secinot, ka atbalsts ir attīstīts un daudzveidīgs, tomēr tam jābūt precīzāk mērķētam, plašāk pieejamam un jāsasniedz augstāka efektivitāte attiecībā uz atbalstīto personu nodarbinātību ilgtermiņā. Šo mērķu sasniegšanai sniegti priekšlikumi atbalsta īstenošanas un normatīvā regulējuma pilnveidei. Pētot personu ar invaliditāti tiesību aizsardzību darba tiesībās, identificēti problēmjautājumi un sniegti priekšlikumi efektīvākai personu ar invaliditāti tiesību aizsardzībai, sloga sabalansēšanai starp valsti un darba devēju ilgtspējīgas iekļaujošas nodarbinātības veicināšanai. Master's thesis studies state support measures for better promotion of employment and rights protection of persons with disabilities in Latvia. The topicality of the subject is determined considering the persistent low levels of public awareness and understanding of the employment support available to persons with disabilities and the rights-protecting norms of the Labour Law. Additionally, the topicality is substantiated by data on societal aging and, in the context of the EU, the general poor health of the population of Latvia, which in turn could increase the number of working age persons requiring additional support in the near future. The work specifically analyses state support for the promotion of persons with disabilities within the framework of active employment measures, thus allowing to conclude that provided support is readily developed and diverse, however, could be targeted more precisely, be more widely available and achieve higher efficiency in terms of supported persons long-term employment. To achieve these goals, proposals to improve support implementation and enhance regulatory framework have been drawn. By researching the protection of the rights of persons with disabilities in Labour Law, issues have been identified and proposals have been drawn for a more effective protection of their rights of persons with disabilities, as well as for balancing the responsibility burden between the state and the employer to promote sustainable and inclusive employment.
