Vienlīdzīgas attieksmes nodrošināšana izglītības iestāžu klientiem ar funkcionēšanas ierobežojumiem

Maģistra darba tēma “Vienlīdzīgas attieksmes nodrošināšana izglītības iestāžu klientiem ar funkcionēšanas ierobežojumiem” ietvaros veiktās izpētes rezultātā, darba autore konstatē, ka ir nepieciešams meklēt risinājumus, kas spētu nodrošināt kvalitatīvu iekļaujošo izglītību vispārējās izglītības iestādēs, lai bērns, kuram ir kādi veselības traucējumi saņemtu vienlīdzīgu attieksmi un izglītību kā to saņem bērni, kuriem nav veselību traucējumi. Patlaban, lai izglītojamais saņemtu asistenta pakalpojumu izglītības iestādē, izglītības iestādes ar asistentu neslēdz darba līgumu, bet gan uzņēmumu līgumu, jo asistenta apmaksa tiek veikta no valsts budžeta līdzekļiem. Lai izvairītos no tā, ka asistents nesaņem sociālās garantijas dēļ tā, ka starp izglītības iestādi un asistentu tiek noslēgts uzņēmuma līgums, tad darba autore pierāda, ka starp izglītības iestādi un asistentu drīkst noslēgt tikai darba līgumu. Tāpat piesaistīt asistenta darba samaksu izglītojamā izglītības iestādes apmeklējumam pret asistentu nav tiesiski. Darba autore secina, ka tiesības uz atbalsta pasākumiem ir ne tikai bērniem, kuriem ir īpašās kopšanas atzīme, bet arī bērniem, kuriem ir invaliditāte, bet īpašā kopšana nav noteikta. Darba autore arī izanalizēja situāciju, kurā var vērsties administratīvajā tiesā, lai izvērtētu izglītības iestādes rīcību, nenodrošinot atbalsta pasākumus, tādejādi diskriminējot bērnu veselības stāvokļa dēļ. As a result of the research carried out within the framework of the Master Thesis "Ensuring equal treatment for educational institutions clients with functional limitations.", the author of the Thesis states the necessity of finding the solution on how to ensure qualitative inclusive education in general educational institutions for a child with health disorders at the same level as it is ensured for any other child who doesn't have health disorders. Currently, in order for a student to receive the service of an assistant in an educational institution, the institution signs an enterprise contract instead of an employment contract which means that the services of the assistant are financed from the state budget. Signing an enterprise contract between an educational institution and an assistant does not receive social guarantees as it can be ensured only if the employment contract is signed between both parties. Accordingly, the author of the thesis proves that in such cases only an employment agreement must be signed between the educational institution and the assistant to ensure that the assistant receives social guarantees. Additionally, it is illegal to link the assistant's salary to the student’s attendance. The author concludes that not only children with special care eligibility but also children who have a disability but no special care eligibility are entitled to receive support measures. The author also analysed the situation in which it is possible to apply to the administrative court to assess the actions of an educational institution in failing to provide support measures, thus discrimination against a child on the basis of health status.
