Īpašuma tiesības attīstība vēsturiskā aspektā Latvijas teritorijā

Abstract

Bakalaura darbā tiek analizēta īpašuma tiesību transformācija Latvijas teritorijā laika posmā no 12. līdz 21.gadsimta sākumam. Darbs strukturēts trīs nodaļās ar apakšnodaļām atbilstoši īpašuma tiesības izpratnes maiņai tagadējā Latvijas teritorijā, īpaši izceļot īpašuma tiesības restitūcijas un privatizācijas aspektus pēc Latvijas neatkarības atjaunošanas de facto. Pētījuma izstrādes rezultātā autore nonākusi pie secinājuma, ka sākot ar 13.gadsimta otru pusi īpašuma tiesības izpratne Baltijas novadā (tātad arī tagadējā Latvijas teritorijā) attīstījās stingrā romiešu-ģermāņu tiesību ģimenes ietekmē. Par zināmu noslēgumu šim ietekmes procesam jāuzskata prof. Georga Frīdriha fon Bunges izstrādātais Baltijas vietējo likumu kopojuma III daļa.

The transformation of property rights within territory of Latvia during the period from the 12th to the beginning of the 21st century was analyzed in the bachelor thesis. According to the change of understanding of property rights in the current theory of Latvia, the work is structured in three chapters with subchapters. The aspects of property restitution and provatization rights after the de facto restoration of Latvia's independence are especially highlighted. As a result of the research, the author has come to the conclusion that starting from the second half of the 13th century, the understanding of property rights in the Baltic region (therefore also in the territory of Latvia nowadays) developed under the strict influence of the Roman-Germanic family of law. Part III of the collection of Baltic local laws developed by Prof. Georg Friedrich von Bunge should be considered as a certain conclusion of this influence process.
