Bakalaura darba tēma ir “Juridisko personu nevainīguma prezumpcija kriminālprocesā”. Izvēlētās tēmas aktualitāti nosaka to, ka 2016. gada 9. martā tika pieņemta Eiropas Parlamenta un Padomes Direktīva (ES) 2016/343, ar kuru nostiprināti konkrēti nevainīguma prezumpcijas aspekti un, kura nav piemērojama juridiskajai personai. Savukārt kopš 2022. gada pieaudzis to uzsākto kriminālprocesu skaits, kuri uzsākti par piespiedu ietekmēšanas līdzekļu piemērošanu juridiskām personām. Tā kā Direktīva jautājumu par nevainīguma prezumpcijas piemērošanu juridiskajām personām nerisina, tad darba mērķis ir izpētīt, juridiskās personas jēdzienu, juridiskās personas krimināltiesiskās atbildības vēsturi, nevainīguma prezumpcijas jēdzienu un principa attiecināšanu uz juridiskajām personām. The topic of the bachelor thesis is "Presumption of innocence of legal entities in criminal proceedings". The relevance of the chosen topic is determined by the fact that Directive (EU) 2016/343 of the European Parliament and Council was adopted on March 9, 2016, which strengthens certain aspects of the presumption of innocence and which is not applicable to legal entities. On the other hand, since 2022, the number of criminal proceedings initiated for the application of means of coercive influence to legal entities has increased. Since the Directive does not address the issue of the application of the presumption of innocence to legal entities, the aim of the work is to investigate the concept of a legal entity, the history of criminal liability of a legal entity, the concept of the presumption of innocence and the application of the principle to legal entities.
