Personas nolaupīšana

Abstract

Maģistra darbs “Personas nolaupīšana” izstrādāts ar mērķi detalizētāk apskatīt nozieguma nozīmīgumu Latvijas Republikā, un kā tiek risināts jautājums, ja tiek apdraudēta personas brīvība. Noskaidrot ar personas nolaupīšanu saistītus problēmjautājumus, ka arī darbā izteikt savas pārdomas, piedāvājot iespējamo risinājumu. Apskatīt citu valstu normatīvos regulējumus, judikatūru, viedokļus un to piekritēju pamatojumus. Izvērtēt iespējamos grozījumus Krimināllikumā, ņemot vērā esošo situāciju Latvijas Republikā un ārvalstīs. Darbā pētīts personas nolaupīšanas jēdziens, citi līdzīgi noziedzīgie nodarījumi, kvalifikācijas problēmas, noziedzīga nodarījuma sastāvs, liekot uzsvaru uz objektīvās puses pazīmi un personas nolaupīšanas izpratnes raksturojums ārvalstīs. Darba autores uzdevumi ir sekojoši: 1)izpētīt personas nolaupīšanas izpratni Latvijas Republikā; 2)analizēt personas nolaupīšanas noziedzīga nodarījuma sastāvu; 3)norobežot personas nolaupīšanu no citiem līdzīgiem noziedzīgiem nodarījumiem; 4)izpētīt kvalifikācijas problēmas; 5)salīdzināt ārvalstu regulējumu ar Krimināllikumā esošo regulējumu. Darba autore piedāvā veikt izmaiņas Krimināllikuma 153.pantā, papildinot ar kvalificējošām pazīmēm, proti, personas nolaupīšana ir veikta pret divām vai vairākām personām; to izdarījusi personu grupa; izmantojot ieroci vai priekšmetu, ko izmanto kā ieroci; vainīgajam apzinoties, ka sieviete ir grūtniecības stāvoklī; mantkārīgā nolūkā. Darba autore piedāvā ieviest Krimināllikuma 153.1 pantu, kurā būtu paredzēta kriminālatbildība par bērna nolaupīšanu, ja to izdara kāds no augšupējiem (izņemot māti un tēvu) vai sānu līnijas radiniekiem.

The master's thesis “Kidnapping of a Person” has been developed with the aim to look in more detail at the significance of the crime in the Republic of Latvia, and how the issue is addressed if a person's freedom is endangered. To find out the problems related to the kidnapping of a person, as well as to express one's thoughts at work, offering a possible solution. To analyze the regulatory enactments, case law, opinions and justifications of other countries. Evaluate possible amendments to the Criminal Law, taking into account the current situation in the Republic of Latvia and abroad. The paper studies the concept of kidnapping, other similar criminal offenses, qualification problems, the crime elements of the criminal offence, emphasizing the characteristics of the objective side and the characteristics of the understanding of kidnapping abroad. The tasks of the author are as follows: 1) to study the understanding of the kidnapping of a person in the Republic of Latvia; 2) to analyze crime elements of the criminal offence of kidnapping a person; 3) to separate the kidnapping of a person from other similar criminal offenses; 4) to study qualification problems; 5) to compare foreign regulation with the regulation in the Criminal Law. The author of the work proposes to make amendments in Section 153 of the Criminal Law, supplementing with qualifying features, namely, the kidnapping of a person has been committed against two or more persons; this has been done by a group of persons; using a weapon or object used as a weapon; the perpetrator being aware that the woman is pregnant; for a greedy purpose. The author proposes to introduce Article 153.1 of the Criminal Law, which would provide for criminal liability for the kidnapping of a child if it is committed by one of the ascendants (except the mother and father) or relatives of the sideline.
