Mantisko interešu aizskārums kriminālprocesa gaitā

Abstract

Maģistra darba nosaukums ir “Mantisko interešu aizskārums kriminālprocesa gaitā”. Šajā formulējumā autors definējis darba pamatā veiktās izpētes būtību – darbā raudzīts atklāt problēmas, ar kurām saskaras personas, kuru mantiskās intereses tiek aizskartas kriminālprocesa gaitā vai tā rezultātā. Darba uzdevums ir noskaidrot, vai Latvijā spēkā esošais kriminālprocesuālais regulējums atbilst LR Satversmē nostiprinātajām pamattiesībām un Latvijai saistošo starptautisko tiesību prasībām. Ja neatbilst – nepieciešams rast risinājumu. Tādējādi darba mērķis ir sniegt priekšlikumus, vai un kā būtu jāpilnveido tiesiskais regulējums, lai galarezultātā personai tiktu nodrošinātas tiesības uz īpašumu un taisnīgu tiesu – LR Satversmē noteiktās pamattiesības, kā arī Latvijai saistošos starptautisko tiesību avotos atrodamu cilvēka tiesību “minimuma standartu”.

The topic of the master’s thesis is “Infringement of property interests in criminal proceedings”. In this wording the author has defined the nature of the research underlying the work – work attempts to discover the problems faced by persons whose property interests are infringed during the criminal proceedings or as a result thereof. The aim is to find out whether the legislation in Latvia complies with the requirements of international laws, such as EU law. If not, a solution needs to be found. Therefore the target of the work is to make proposals, whether and how the legal framework should be improved in order to ensure that a person is entitled to property and a fair trial in the end - Fundamental rights specified in the Constitution of the LR, as well as the “minimum standard” of human rights found in the sources of international law binding on Latvia.
