Personas privātautonomija kā tiesības lemt par savu ķermeni

Abstract

Maģistra darbs “Personas privātautonomija kā tiesības lemt par savu ķermeni” veltīts personas privātautonomijas aspektu, konkrētāk personas pašnoteikšanās tiesību pār savu ķermeni, izpētei un problēmu aktualizēšanai. Maģistra darba mērķis ir noskaidrot personas privātautonomijas saturu tiesību lemt par savu ķermeni kontekstā, atklājot obligātās vakcinācijas pamatotību un saskaņošanu ar tiesībām lemt par savu ķermeni, prezumētās piekrišanas jeb opt-out sistēmas stūrakmeņus, kā arī iespējami veiksmīgākā risinājuma ierosināšana, lai netiktu nepamatoti aizskartas personas tiesības. Maģistra darbā ir sekojoši uzdevumi – personas privātautonomijas kā tiesību lemt par savu ķermeni institūta izpēte šobrīd aktuālu tā izpausmes veidu kontekstā, obligātās vakcinācijas pret Covid-19 pamatotības aspekti, sasaiste ar personas tiesībām lemt par savu ķermeni, kā arī noskaidrot, vai prezumētās piekrišanas jeb opt-out sistēmas ietvaros personas tiesības un patiesā griba par savu ķermeni tiek ņemta vērā pietiekami lielā mērā. Autore secināja, ka vakcinācijas pret Covid-19 kontekstā personas netika piespiestas vakcinēties, tādējādi neatstājot rīcības brīvību. Ieviešot opt-out orgānu ziedošanas sistēmu, nav pieņemami no valstu puses pamatoties vienīgi uz orgānu donoru skaita palielināšanos, katrai valstij jāvērtē, vai ar šādu rīcību netiek nepamatoti aizskartas personas pašnoteikšanās pa savu ķermeni tiesības. Būtiska nozīme ir personu izglītošanai un informēšanai abos personas tiesību lemt par savu ķermeni apskatītajos īstenošanas virzienos.

The Master's thesis "Personal autonomy as the right to decide about one's own body" is dedicated to the study of aspects of personal autonomy, more specifically, the right to self-determination of a person over one's own body, and to actualizing the problems. The aim of the master's thesis is to find out the content of a person's private autonomy in the context of the right to decide about one's own body, revealing the validity and coordination of mandatory vaccination with the right to decide about one's own body, the cornerstones of the presumed consent or opt-out system, as well as proposing the most successful possible solution so that a person's rights are not unjustifiably violated. The master's thesis has the following tasks - the research of the institute of personal autonomy as the right to decide about one's own body in the context of currently relevant ways of its expression, the aspects of the validity of mandatory vaccination against Covid-19, the connection with the right of a person to decide about one's own body, as well as to find out whether within the framework of the presumed consent or opt-out system, a person's rights and true will for his body are taken into account to a sufficient extent. The author concluded that in the context of vaccination against Covid-19, persons were not forced to get vaccinated, thus leaving no freedom of action. When implementing the opt-out organ donation system, it is not acceptable for countries to base themselves solely on the increase in the number of organ donors, each country must assess whether such an action does not unreasonably violate the right of a person to self-determination over his own body. Educating and informing persons in both directions of the discussed implementation of the right of a person to decide about his body is essential.
