Notariālo funkciju realizācija bāriņtiesās

Abstract

Pēdējo gadu laikā aizvien vairāk tiek pievērsta uzmanība tam, kā bāriņtiesas realizē primāros uzdevumus. Darba mērķis ir izpētīt bāriņtiesu institūta izveidi kopsakarā ar notariālo funkciju realizēšanu. Darba uzdevumi ir analizēt bāriņtiesu normatīvo regulējumu un notariālo funkciju īstenošanu, izpētot arī zvērinātu notāru institūtu, un izvērtēt grozījumus Bāriņtiesu likumā un likumprojektu “Grozījumi bāriņtiesu likumā”. Darba rezultātā tiek piedāvāts ietvert grozījumus Bāriņtiesu likuma 7. panta ceturtajā daļā, Bāriņtiesu likuma 45. panta pirmajā daļā, Bāriņtiesu likuma 60. panta pirmajā, otrajā un trešajā daļā, un Bāriņtiesu likuma 61. panta pirmās daļas 4. punktā.

In recent years, increasingly more attention has been paid so that the Orphan's and Custody Courts fulfill their primary tasks. The aim of the master’s thesis is to explore the establishment of the institute of the Orphan's and Custody Court in connection with the implementation of notarial functions. The tasks of the master's thesis are to analyze the regulatory framework of the Orphan's and Custody Court and the implementation of notarial functions, to study the institute of sworn notary, as well as evaluate the amendments to the Law on Orphan's and Custody Courts and the draft law “Amendments to the Law on Orphan's and Custody Courts”. As a result of the thesis, the author proposes to include amendments to Section 7(4), Section 45(1), Section 60(1), (2) and (3), as well as Section 61(1)(4) of the Law on Orphan's and Custody Courts.
