Kopīpašuma izbeigšana

Abstract

Autores izvēlētā maģistra darba tēma ir “Kopīpašuma izbeigšana”. Mūsdienās, Latvijas normatīvie akti paredz vairākus 7 dalīšanas veidus kopīpašuma izbeigšanai. Maģistra darba mērķis ir izpētīt šobrīd modernizētā kopīpašuma izbeigšanas veidu efektivitāti un piemērotību Latvijā, tā regulējumu esošajos normatīvajos aktos un esošās problēmas, kuras ir nepieciešamas atrisināt, kā arī salīdzināt kopīpašuma izbeigšanas regulējumu atšķirību starp citām valstīm. Tāpat darba mērķis ir kopīpašuma izbeigšanas problemātiku. Darba gaitā autore ir analizējusi dažādu autoru rakstus, kā arī Latvijas un ārzemju tiesu praksi. Darba mērķa sasniegšanai bija izvirzīts izpētīt un analizēt Civillikuma 1074. un 1075.pantu grozījumus, kas stājās spēkā 2022.gada 1.maijā.

The topic of the master's thesis chosen by the author is "Termination of joint ownership". Nowadays, the laws of Latvia provide for several 7 types of division for the termination of co-ownership. The aim of the Master's thesis is to investigate the effectiveness and suitability of the currently modernized methods of termination of joint ownership in Latvia, its regulation in the existing regulatory acts and the existing problems that need to be solved, as well as to compare the differences in the regulations for termination of joint ownership between other countries. Also, the aim of the work is to solve the problems of termination of joint ownership. In the course of the work, the author has analyzed the articles of various authors, as well as the practice of Latvian and foreign courts. In order to achieve the goal of the work, it was set to study and analyze the amendments to Articles 1074 and 1075 of the Civil Law, which entered into force on May 1st,2022.
