Procesu par noziedzīgi iegūtu mantu problēmjautājumi un to iespējamie risinājumi

Abstract

Bakalaura darba temats ir “Procesu par noziedzīgi iegūtu mantu problēmjautājumi un to iespējamie risinājumi”. Darba mērķis ir noskaidrot, vai process par noziedzīgi iegūtu mantu Latvijā ir taisnīgs un atbilstošs Eiropas Savienības standartiem. Bakalaura darba uzdevumi ir izpētīt Latvijas regulējumu un tiesu praksi, un Eiropas Savienības tiesu praksi, kas attiecas uz procesiem par noziedzīgi iegūtu mantu, kā arī saprast, kādi problēmjautājumi šajos procesos pastāv un kā tos var atrisināt. Darba gaitā autore ir secinājusi, ka pētītajos procesos ir diezgan daudz problēmatisko aspektu, kuri radušies netaisnīga regulējuma dēļ vai nepareizas tiesību normu interpretācijas dēļ, vai arī abu problēmu apvienošanās dēļ.

The topic of the bachelor's thesis is "Problems and possible solutions of the process of criminally obtained property". The purpose of the thesis is to find out whether the process of criminally obtained property in Latvia is fair and meets the standards of the European Union. Bachelor thesis tasks are to study Latvian regulation and court practice, and the European Union's case law, relating to criminal proceedings, as well as to understand what issues exist in these proceedings and how they can be resolved. In the course of the thesis, the author has concluded that there are quite a lot of problematic aspects in the studied processes, which arose due to unfair regulation or incorrect interpretation of legal norms, or due to both of these problems combining.
