Labas likumdošanas principa atvasināšana un konkretizācija Latvijas tiesiskajā sistēmā

Abstract

Darba mērķis ir analizēt labas likumdošanas principa nozīmi un saturu Latvijas tiesiskajā sistēmā un tā piemērošanu tiesību praksē. Bakalaura darbā pētīts, kā tika atvasināts un konkretizēts labas likumdošanas princips, kā arī, kā tas sekmē kvalitatīvu likumdošanas procesu Latvijā. Kvalitatīvs likumdošanas process ir viens no veidiem, kā var sekmēt tautas uzticību likumdevējam un valstij. Darbā tiek sniegta labas likumdošanas principa elementu analīze, kuri ir jāievēro likumdevējam. Labas likumdošanas principa neievērošana ir viena no problēmām likumdošanas procesā, par ko arī liecina apjomīgā Satversmes tiesas judikatūra. Autors darbā secinājis, ka Satversmes tiesai ir būtiska nozīme likumdošanas procesā, nodrošinot likumdevēja padotību vispārējiem tiesību principiem un Satversmei normatīvo tiesību aktu jaunradē.

The aim of this paper is to analyse the meaning and content of the principle of good legislation in the Latvian legal system and its application in legal practice. This bachelor thesis examines how the principle of good legislation was derived and concretized, as well as how it contributes to a quality legislative process in Latvia. A good legislative process is one of the ways in which public confidence in the legislature and the state can be promoted. The paper analyses the elements of the principle of good lawmaking that the legislature must respect. Failure to respect the principle of good legislation is one of the problems in the legislative process, as evidenced by the extensive case law of the Constitutional Court. The author has concluded that the Constitutional Court has an important role in the legislative process, ensuring the subordination of the legislature to the general principles of law and the Constitution in the creation of normative legal acts.
