Bakalaura darbā “Apelācijas instances tiesas loma civilprocesuālajā tiesvedībā” tiek pētīts apelācijas instances institūts un tā procesuālie aspekti, kā arī ar to saistītie problēmjautājumi. Darba mērķis ir izpētīt kā praksē tiesa ievēro likumdevēja noteiktās iztiesāšanas robežas apelācijas kārtībā un to kā lietas dalībnieki izmanto pārsūdzības veidus savu likumīgo interešu aizstāvībai. Darbā tiek aplūkots arī citu Eiropas valstu tiesiskais regulējums lietu iztiesāšanā apelācijas kārtībā un veikts tā salīdzinājums ar Latvijas tiesisko regulējumu. Civilprocesa likums nosaka, ka apelācijas instances tiesa izskata lietu pēc būtības tādā apjomā, kāds lūgts šajās sūdzībās un prasības priekšmeta vai pamata grozīšana nav pieļaujama. Pētījuma rezultātā darba autore secina, ka praksē apelācijas instancei ne vienmēr izdodas ievērot likumdevēja noteiktās iztiesāšanas robežas. Ietekmējošs faktors ir arī lietas dalībnieku sagatavotās sūdzības kvalitāte un tas vai persona šo institūtu izmanto godprātīgi. The bachelor's thesis "The role of the appellate court in civil procedure proceeding" examines the institute of the appellate instance and its procedural aspects as well as the problems related to it. The aim of the work is to research how in practice the court observes the limits regarding examination determined by the legislator in the appeal procedure and how the participants in the case use the types of appeal to defend their legal interests. Author also examines the legal regulation of other European countries in the appeal court proceedings and compares it with the legal regulation in Latvia. The Civil Procedure Law regulates that an appellate court shall examine a case on the merits to the extent as is requested for in such complaint and amendment of the subject-matter or the basis of an action shall not be permitted. During research the author concludes that in practice the appellate instance does not always succeed in observing limits regarding examination determined by the legislator. An influencing factor is also the quality of the complaint prepared by the parties and whether the person uses this institute in good faith.
