Taisnīguma nodrošināšana kā Latvijas tiesiskās sistēmas mērķis

Abstract

Latvijas tauta, jeb suverēns ir izteikusi savu gribu dzīvot demokrātiskā tiesiskā valstī. No šī suverēna gribas akta – pamatnormas izriet tiesiskās sekas, kas noteic Latvijas valsts pamatus. Viens no šiem pamatiem ir taisnīguma nodrošināšana kā Latvijas tiesiskās sistēmas mērķis un taisnīgums kā Latvijas tiesiskajā sistēmā pastāvošs vispārējais tiesību princips. Tā kā iepriekš izteiktā pamatnorma ir saistoša pašam suverēnam, no taisnīguma kā tiesiskās sistēmas mērķa un vispārējā tiesību principa tiesiskā ceļā vairs nav iespējams atkāpties. Maģistra darba mērķis ir noteikt taisnīguma kā mērķa vietu Latvijas tiesiskajā sistēmā, noskaidrot taisnīguma jēdziena saturu Latvijā kā demokrātiskā tiesiskā valstī un aplūkot taisnīguma kā tiesiskās sistēmas mērķa nodrošināšanas mehānismus un taisnīguma kā vispārējā tiesību principa piemērošanas problēmjautājumus.

The people of Latvia, or the sovereign, has expressed its will to live in a democratic state governed by the rule of law. From this act of sovereign will – the basic norm, legal consequences follow that determine the foundations of Latvia. One of these foundations is ensuring justice as the purpose of Latvian legal system and justice as a general legal principle existing in the Latvian legal system. Since the previously expressed basic norm is binding on the sovereign itself, it is no longer possible to lawfully deviate from justice as the goal of the legal system and the general legal principle. The aim of the master’s thesis is to determine the place of justice as the purpose of Latvian legal system, to clarify the content of the concept of justice in Latvia as a democratic state governed by the rule of law, and to explore the mechanisms for ensuring justice as the goal of the legal system and the issues of applying justice as a general legal principle.
