Pacienta informētās piekrišanas regulējuma problemātika veselības aprūpē

Abstract

Pacienta informētā piekrišana ir viena no cilvēka pamattiesībām, kas ir obligāts priekšnosacījums jebkuram veselības aprūpes pakalpojumam. Informētā piekrišana ir process, kurā pacientam tiek sniegta informācija par nepieciešamo veselības aprūpes pakalpojumu, t.sk. informācija par riskiem, komplikācijām, ieguvumiem, sekām. Maģistra darba mērķis ir izpētīt pacienta informētās piekrišanas problemātiku veselības aprūpē. Darba uzdevumi ir izpētīt pacientu tiesības, pacienta informētās piekrišanas tiesisko regulējumu Eiropas un Latvijas tiesību aktos un tiesu praksēs, kā arī pētīt informētās piekrišanas regulējuma problemātiku veselības aprūpē. Maģistra darba rezultātā tika secināts, ka informētās piekrišanas iegūšanas procesā svarīga ir ne tikai informētā piekrišana un informētās piekrišanas veidlapas parakstīšana, bet arī savstarpējā komunikācija starp pacientu un veselības aprūpes speciālistu, kā arī pacientam saprotama informētās piekrišanas veidlapa par nepieciešamo veselības aprūpes pakalpojumu. Informed consent is a fundamental human right that is a prerequisite for any healthcare service. Informed consent is the process by which a patient is provided with information about the required healthcare service, including information about risks, complications, benefits, and consequences. The aim of the master's thesis is to study the problems of patient informed consent in healthcare. The tasks of the thesis are to study patients' rights, the legal regulation of patient informed consent in European and Latvian legislation and case law, as well as to study the problems of informed consent regulation in healthcare. The master's thesis concluded that in the process of obtaining informed consent, not only informed consent and signing the informed consent form are important, but also mutual communication between the patient and the healthcare professional, as well as an informed consent form for the necessary healthcare service that is understandable to the patient.
