Biedrību tiesības vērsties Satversmes tiesā.

Abstract

Šī darba mērķis ir noskaidrot biedrības kā privāto tiesību juridiskas personas tiesību vērsties Satversmes tiesā apjomu, iespējamo atšķirību no citu privāto tiesību juridisko personu tiesībām vērsties Satversmes tiesā, kas secināma no biedrību un to mērķu specifikas. Pētot Satversmes tiesā dažādu biedrību iesniegtos pieteikumus, autore konstatēja, ka par vairākumu no tiem rezultātā tiek pieņemts Satversmes tiesas kolēģijas lēmums par atteikšanos ierosināt lietu, kā pamatojumu norādot pieteikuma neatbilstību konstitucionālajai sūdzībai izvirzītajām prasībām. Tāpat Satversmes tiesas praksē autore novēroja atšķirīgu locus standi kritēriju interpretāciju, Satversmes tiesai, vērtējot biedrības konstitucionālās sūdzības, kas iesniegta par pārkāpumiem vides jomā, atbilstību Satversmes tiesas likumā ietvertajām prasībām. Darbā konstatēti noteikti pamatkritēriji, kas biedrību atšķir no parastas personu apvienības vai cita veida privāto tiesību juridiskās personas un kas kalpo par pamatu, lai biedrība varētu īstenot tiesības vērsties Satversmes tiesā. Tāpat darbā izdarīti secinājumi par to, kādēļ lielākā daļā no biedrību iesniegtajiem pieteikumiem Satversmes tiesā ir actio popularis nevis konstitucionālā sūdzība, kā arī par biedrību spēju, Satversmes 115.pantā noteikto pamattiesību aizskāruma gadījumā, iesniegt konstitucionālo sūdzību, nepieciešamajiem biedrības locus standi kritērijiem un ar to saistītiem problēmjautājumiem.

The goal of this thesis is to explore the capacity of the rights to turn to the constitutional court of the associations who act as legal persons of the private law, possible differences that may arise given the specificity of the associations and their purpose between these associations and other legal persons of the private law. By exploring the various applications to the constitutional court from the associations mentioned above, the author has come to the conclusion that most of them have been denied by the board of the constitutional court due to their incompatibility with the requirements set for the applicability of the constitutional complaint. As well as that the author observed a very different interpretation of the criteria of locus standi set in the Constitutional court law, that have been applied to the judging of the constitutional complaints submitted by these associations concerning possible infringements of the environmental law. As a result of the research, the author has detected certain milestones that distinguish association acting as a legal person of the private law from any other sort of legal persons of the private law and that serve as a basis for these associations to exercise their rights to turn to constitutional court. There are conclusions made in this thesis why the most of the applications to the constitutional court from these associations can be classified as actio popularis instead of a constitutional complaint as well as conclusions about the ability of these associations to submit a constitutional complaint to constitutional court in case of the infringement of the fundamental rights set in the article 115 of the Latvian constitution, the necessary criteria of locus standi these associations have to meet and other challenges concerning the topic.
