Patērētāja un kreditora attiecību tiesiskais regulējums

Abstract

Pētījumā „Patērētāja un kreditora attiecību tiesiskais regulējums” izklāstītas aktuālās problēmas patērētāju kreditēšanas jomā un analizētas iespējas, kā problēmas atrisināt. Būtiski grozījumi veikti Latvijas Patērētāju tiesību aizsardzības likumā attiecībā uz galvinieka statusu un noteiktas skaidrākas un stingrākas prasības attiecībā uz patērētāju kreditēšanu saistībā ar Eiropas Parlamenta un Padomes 2008.gada 23.aprīļa Direktīvas 2008/48/EK ieviešanu nacionālajos tiesību aktos. Darba rezultātā ir piedāvātas teorētiskas un praktiski pielietojamas atziņas, sniegta izpratne par patērētāja un kreditora attiecībām, norādīts uz strīdu risināšanas iespejām, kas būtiski varētu uzlabot Patērētāju tiesību aizsardzības centra un tiesu darbu, kā arī patērētāju tiesību un interešu aizsardzību.

The research "The regulatory relations of the consumer and creditor" sets out the current challenges in the field of consumer crediting and the opportunities are analyzed how to solve the issues. Substantial amendments are made in the Law on the Latvian Consumer Rights Protection for the status of a guarantor in the consumer rights and clearer and more stringent requirements are set for the consumer crediting in relation to introducing the European Parliament and Council Directive 2008/48/EC of 23 April 2008 in the national legislation. The first section of the research examines the concept of a consumer but the second section defines the concept of a creditor. The third section is devoted to a detailed analysis of a consumption credit agreement, giving the reader understanding of the legal framework of the consumption credit agreement, unfair terms of the agreement and options for dispute resolution.
