Bezdarbnieka statusa iegūšana un zaudēšana.

Abstract

Maģistra darba tēma ir „Bezdarbnieka statusa iegūšana un zaudēšana”. Maģistra darbs sastāv no četrām nodaļām, kurās noskaidrota bezdarbnieka statusa iegūšanas un zaudēšanas vēsturiskā attīstība Latvijā; atklāta bezdarbnieka statusa iegūšanas būtība un kritēriji, konstatējot ar to saistītās problēmas praksē. Tika izpētīti bezdarbnieka statusa zaudēšanas pamati un ar to saistītās problēmas praksē. Kā arī tika aplūkota reālā situācija, kāda šobrīd izveidojusies Latvijā attiecībā uz nelegāli nodarbinātajām personām, kuras vienlaicīgi ieguvušas bezdarbnieka statusu, analizējot Latvijas normatīvos aktus, Aģentūras un tiesu praksi. Maģistra darba mērķis ir, analizējot bezdarbnieka statusa iegūšanas un zaudēšanas normatīvo regulējumu un praksi, sniegt ierosinājumus Latvijas normatīvā regulējuma bezdarbnieka statusa iegūšanas un zaudēšanas kontekstā pilnveidošanai. Darba rezultātā tika konstatētas bezdarbnieka statusa iegūšanas un zaudēšanas problēmas praksē un sniegti konkrēti ierosinājumi Latvijas spēkā esošo normatīvo aktu bezdarbnieka statusa iegūšanas un zaudēšanas kontekstā pilnveidošanai un to realizācijai praksē. Darbā problēmu analīzei ir izmantoti Latvijas Republikas normatīvie akti, juridiskā literatūra, dažādu autoru publikācijas, Aģentūras un tiesu prakse.

The subject of the Master Paper is Acquisition and Loss of Unemployed Person Status. The Master Paper consists of the four chapters, in which are stated the historical background of the acquisition and loss of unemployed person status in Latvia; it is investigated the essence and criteria of the acquisition of unemployed person status considered the problems in practice. There are investigated the reasons of the loss of unemployed person status and problems connected with that in practice. Also it is analysed the actual situation in relation to illegal jobholders who at the same time has the unemployed person status. It is considered the Latvian legislation, and also judicial practice and State Employment Agency practice. The object of the Master Paper, analysing the practice and normative regulation of the acquisition and loss of unemployed person status, is to suggest the possible ways of Latvian legislation improvement in respect of the acquisition and loss of unemployed person status. As a result of research there are stated the problems of the acquisition and loss of unemployed person status in practice and made the specific conclusions for the current Latvian legislation improvement in respect of the acquisition and loss of unemployed person status and practice of its implementation. In the Master Paper are used regulatory acts, legal literature and Internet research.
