Kapitāla brīvas aprites ierobežojumi Eiropas Savienībā

Abstract

Bakalaura darbs ir vērsts uz kapitāla brīvas aprites ierobežojumu izpēti Eiropas Savienības teritorijā, kā arī uz to iespējamiem attaisnojumiem un grūtībām, kas saistās ar šādu ierobežojumu konstatēšanu. Darbā tiek plaši aplūkota Eiropas Savienības Tiesas prakse, kas skar kapitāla brīvas aprites ierobežojumus dažādās sfērās. Autors salīdzina atšķirīgas pieejas, kuras izmanto attiecīgo ierobežojumu konstatēšanai, un apskata gadījumus, kad šādi ierobežojumi var tikt attaisnoti. Autors piedāvā atzīt, ka kapitāla brīvas aprites ierobežojumiem var piemist arī horizontālā tiešā iedarbība, kas ļautu novērst indivīdu radītos šķēršļus kapitāla brīvai apritei.

The bachelor thesis focuses on the research of the restrictions on the free movement of capital in the European Union, as well as on possible justifications and difficulties associated with the detection of such restrictions. Work widely discusses The Court of Justice of the European Union jurisprudence concerning restrictions on the free movement of capital in various fields. The author compares different approaches used in the detection of such restrictions and deals with the cases in which such restrictions can be justified. The author proposes to recognize that restrictions on the free movement of capital may also have the horizontal direct effect, which would help to prevent the obstacles to the free movement of capital created by individuals.
