Darbinieka tiesību un pienākumu kopuma regulējums darba tiesiskajās attiecībās

Abstract

Tiesu prakse un aptaujas rezultāti nodemonstrē, ka Latvijas iedzīvotāji diezgan zemā līmenī orientējas darba tiesiskās attiecībās. Dažas darba tiesību normas neizpilda savus uzdevumus, līdz ar to, darbinieka tiesības ir nepilnvērtīgas, bet darbinieka pienākumi ir nenoteikti. Šajā sakarā, autors nolēma izskatīt tiesību, pienākumu un atbildības institūtus, ko likumdevējs nosaka darbiniekam Satversmē un Darba likumā, lai labāk izprastu šādu institūtu nozīmi darbinieka darba tiesisko attiecību īstenošanas ietvaros. Bakalaura darba rezultātos autors izskaidro neviennozīmīgas darba tiesību normu piemērošanu, norāda aktuālas darba tiesiskās attiecības problēmas un piedāvā risinājumus aktuālo problēmu novēršanai, ņemot vērā Latvijas pašreizējo attīstības situāciju, tiesu praksi un ārzemju praksi.

The judicial practice and the results of the interview confirms that Latvian people has a low-level orientation about employment legal relationship. Some of the rules in labour law do not perform its tasks, in this connection some employee's rights are defective, and some obligations are not defined. Therefore, the author decided to examine the institutions of the rights, obligations and responsibilities, which the legislator proclaiming in Constitution and Labour Law, to better understand the role of the Institutions of employment legal relationships. In the result of Bachelor's work author clarifies the law, show the problems in labour legislation and makes an offer to improve its problems, taking in attention of current situation in Latvia, the cases (The Latvian judicial practice) and international practices (foreign countries practice).
