Īrnieka statuss izpildu lietas ietvaros rīkotā nekustamā īpašuma izsolē

Abstract

Bakalaura darba tēmu autore ir izvēlējusies „Īrnieka statuss izpildu lietas ietvaros rīkotā nekustamā īpašuma izsolē”. Izvēlētā darba tēma patlaban ir aktuāla un nozīmīga, jo no īres tiesiskajām attiecībām izrietošie strīdi skar īrnieku Satversmē nostiprinātās pamattiesības no vienas puses un jauno īpašnieku tiesības uz īpašumu no otras puses. Bakalaura darbs sastāv no četrām nodaļām, ievada un kopsavilkuma. Darba mērķis ir sniegt ieskatu īrnieka tiesisko statusu Latvijas Republikā un ar to saistītajā problemātikā, kā arī izpētīt reālo situāciju, kāda ir izveidojusies tiesu praksē, skatot attiecīgas kategorijas civillietas. Darbs pārsvarā ir balstīts uz šobrīd spēkā esošo Civilprocesa likumu, kā arī dažādiem risinājumiem Latvijas Republikas tiesu praksē. Autore piedāvā iespēju likumdošanā iestrādātās teorētiskās nostādnes salīdzināt ar likumdošanas aktu tulkošanu un izmantošanu tiesu praksē, sniedzot savu vērtējumu par grozījumu izdarīšanu likumdošanā. -

The theme of the Bachelor thesis is „Status of tenant in real property auction organized within executive case”. The chosen theme of the thesis is currently topical and significant as the disputes arising from the legal relationship of rent affect the basic rights of the tenants registered in the Constitution on the one hand and the rights of the new owners to the real property on the other hand. The Bachelor thesis consists of four chapters, introductory part and summary. The objective of the thesis is to provide the insight in the legal status of tenants in the Republic of Latvia and in the problems related to it, as well as to explore the real situation, which have developed in the legal practice, reviewing the civil cases of the respective category. The thesis is mostly based on the current valid Civil Procedure law as well as to different settlements in the legal practice of the Republic of Latvia. The author offers the possibility to compare the theoretical approaches introduced in the legislation with the translation of legal acts and their usage in the legal practice, providing own evaluation on the modification introduction in the legislation.
