Krimināllikuma 150.pants. Sociālā naida un nesaticības izraisīšana

Abstract

Bakalaura darba mērķis ir izpētīt Krimināllikuma 150.panta – “Sociālā naida un nesaticības izraisīšana” – vēsturisko attīstību, normatīvo regulējumu, tiesu praksi un aktuālos problēmjautājumus. Darba aktualitāti pamato sabiedrības pieaugošā interese par naida noziegumiem un to ietekmi uz sabiedrības drošību un saliedētību, kā arī nepieciešamība rast līdzsvaru starp runas brīvību un diskriminācijas aizliegumu. Lai sasniegtu mērķi, tika izvirzīti šādi uzdevumi: izpētīt Krimināllikuma 150.panta vēsturisko attīstību; izpētīt starptautisko regulējumu saistībā ar naida noziegumiem un naida runu; veikt Krimināllikuma 150.pantā iekļautā noziedzīgā nodarījuma sastāva analīzi; raksturot un salīdzināt, kā naida runa ir regulēta ārvalstu tiesiskajā regulējumā; izdarīt secinājumus un sniegt priekšlikumus. The aim of the bachelor's thesis is to examine Article 150 of the Criminal Law – "Incitement of Social Hatred and Discord" – focusing on its historical development, legal framework, case law, and current issues. The relevance of the topic is based on the growing public interest in hate crimes and their impact on public safety and social cohesion, as well as the need to find a balance between freedom of speech and the prohibition of discrimination. In order to achieve the objective, the following tasks were set: to examine the historical development of Article 150 of the Criminal Law; to study international regulations related to hate crimes and hate speech; to analyse the elements of the criminal offense defined in Article 150; to describe and compare how hate speech is regulated in foreign legal systems; and to draw conclusions and provide recommendations.
